1. Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of the Better Marriage University website at bettermarriageuniversity.com and all related services, courses, and content (collectively, "the Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you meet this requirement and that the information you provide is accurate and complete.
3. Accounts
To access certain Services, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at better@bettermarriageuniversity.com if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Membership and Subscriptions
Some Services are available through a paid membership or subscription. By enrolling, you authorize us to charge your payment method on a recurring basis at the rate and frequency disclosed at the time of purchase.
Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at better@bettermarriageuniversity.com. Cancellation takes effect at the end of your current billing period. You will retain access to member content through that date.
Refunds: All sales are final unless otherwise stated at the time of purchase. If you believe you were charged in error, contact us within 14 days of the charge and we will review your request.
Price Changes: We may change subscription pricing at any time. We will provide advance notice of any price change before it takes effect on your account.
5. SMS and Text Messaging
By providing your phone number and opting into our SMS program, you consent to receive recurring automated marketing and informational text messages from Better Marriage University via Klaviyo, our messaging platform. Message frequency varies. Message and data rates may apply.
To opt out, reply STOP to any message. Reply HELP for assistance, or contact better@bettermarriageuniversity.com.
Your participation in our SMS program is subject to our Privacy Policy, which governs how we collect and use your phone number and messaging data.
6. Intellectual Property
All content on the Services, including course materials, videos, audio, text, graphics, logos, and downloads, is owned by or licensed to Better Marriage University and is protected by copyright and other intellectual property laws.
You may access and use content for your personal, non-commercial use only. You may not:
Copy, reproduce, distribute, or publicly display any content without our written permission
Sell, sublicense, or commercially exploit any content
Remove or alter any copyright, trademark, or other proprietary notices
Use content to create derivative works or competing products
7. User Conduct
You agree not to use the Services to:
Violate any applicable law or regulation
Harass, abuse, or harm another person
Upload or transmit viruses, malware, or other harmful code
Attempt to gain unauthorized access to any part of the Services
Engage in data scraping, harvesting, or automated data collection
Impersonate any person or entity
We reserve the right to remove any content and suspend or terminate any account that violates these standards.
8. User-Submitted Content
If you submit reviews, comments, or other content to the Services, you grant Better Marriage University a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content in connection with operating and promoting the Services. You represent that you have the right to grant this license and that your content does not violate any third-party rights.
We reserve the right to remove any user-submitted content at our sole discretion.
9. Third-Party Services
The Services may integrate with or link to third-party platforms, including Kajabi (course delivery) and Klaviyo (email and SMS). Your use of those platforms is subject to their own terms and privacy policies. We are not responsible for the practices or content of any third-party service.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. Better Marriage University does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
The content provided through the Services, including coaching, courses, and educational materials, is for informational and personal development purposes only. It does not constitute professional counseling, therapy, or legal advice. For serious personal, marital, or mental health concerns, consult a licensed professional.
11. Limitation of Liability
To the fullest extent permitted by law, Better Marriage University and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of or inability to use the Services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or the Services will not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Better Marriage University and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page with a revised date. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
